Terms of Service

By accessing or using Estimatic ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms.

Estimatic provides an AI-powered vehicle damage estimation platform for auto body shops. The Service includes an embeddable website widget, a dashboard for managing leads and estimates, AI-powered damage analysis, and notification delivery.

To use the Service, you must create an account with accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

• Estimatic offers subscription plans billed monthly. Prices are listed on our Pricing page and may change with 30 days' notice.
• Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method.
• You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
• We offer a 14-day free trial for new accounts. No credit card is required to start the trial.
• Refunds are handled on a case-by-case basis. Contact support within 7 days of a charge for consideration.

You agree not to:

• Use the Service for any unlawful purpose
• Submit fraudulent damage claims or false vehicle information
• Attempt to reverse-engineer, decompile, or extract our AI models
• Interfere with the security or integrity of the Service
• Resell or redistribute access to the Service without authorization
• Use automated bots to submit widget forms (spam)
• Upload content that is illegal, harmful, or infringes on third-party rights

Estimatic does not guarantee the accuracy of AI-generated estimates. Shop owners are responsible for verifying estimates before providing final pricing to customers. Estimates should be used as a lead qualification and engagement tool, not as a substitute for professional in-person assessment.

• Your Data: You retain ownership of all data you submit to the Service, including shop information, customer submissions, and uploaded photos.
• Customer Data: Lead data submitted through your widget belongs to you. We act as a data processor on your behalf.
• Our Rights: We may use anonymized, aggregated data to improve the Service, including AI model accuracy. No personally identifiable information is used for this purpose without consent.

The Service, including its design, code, AI models, branding, and documentation, is owned by Estimatic and protected by intellectual property laws. Your subscription grants a limited, non-exclusive, non-transferable license to use the Service for your business operations.

Estimatic integrates with third-party services (Stripe, Supabase, OpenAI, Google AI, Twilio, Resend). Your use of the Service may be subject to the terms and policies of these providers. We are not responsible for the availability, accuracy, or practices of third-party services.

To the maximum extent permitted by law, Estimatic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims related to the Service shall not exceed the total amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Estimatic from any claims, damages, losses, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) customer disputes related to estimates generated through your widget.

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. You may export your data before account deletion.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
